New regulations for fragrances in cosmetics

The area of analysis and declaration of allergenic fragrances in cosmetics is currently changing.

In general, certain fragrances in cosmetics must be declared above a certain amount (according to Annex III to Regulation (EC) No. 1223/2009: 10 ppm for leave-on products, 100 ppm for rinse-off products), the use of individual fragrances is permitted in accordance with Annex .II to Regulation (EC) No. 1223/2009 is even forbidden or is forbidden.

From August 23, 2021 at the latest, cosmetics containing one of the fragrances atranol, chloratranol or hydroxyisohexyl-3-cyclohexene carboxyaldehydes (Lyral) may no longer be sold. Furthermore, a sales ban will also apply for the fragrance butylphenyl methylproprional (Lilial) from March 2022.

An amending ordinance is currently being discussed with the expected adoption in the first quarter of 2022, which will identify around 50-60 other fragrances with a corresponding declaration requirement for the currently regulated fragrances. The basis for this is an SCCS opinion, which comes to the conclusion that the declaration of further fragrances is necessary with regard to preventive health protection.
